CTBA Calls VAWA Law “Historic Collaboration” Posted: 07 Mar 2013 02:24 PM PST
In what can only be viewed as an historic collaboration between Tribal nations and the U.S. Government, President Barack Obama signed the Violence Against Women Act (VAWA) reauthorization today. The new law includes provisions that allow Tribal courts to prosecute non-Indians who commit violence against women and families on Indian lands. "There has never been a question that Tribes should have criminal jurisdiction over our Tribal lands. That said, we have been unable to enforce this fundamental point among non-Indians from the standpoint of U.S. legal precedence," said CTBA Chairman Robert Smith. "By signing this provision into VAWA, the President is making a very clear statement about his commitment to protect women and families. He is also being very clear about his support of Native American sovereignty, upholding a basic principle that supports our ability to govern our own lands and protect our wives, daughters, mothers and families." Ever since the U.S. Supreme Court ruled in 1978 that tribal courts lack criminal jurisdiction over non-Indians, most crimes committed by non-Indians on Tribal lands have gone unpunished. Today, Tribal leaders are hoping that will change. Among the provisions included in the Act, Tribes will have the authority to prosecute non-Indians for domestic violence, dating violence, and violations of protection orders.

March 07, 2013 On February 26, Gov. Chris Christie signed a bill legalizing Internet gambling, making New Jersey the third state in the nation, after Delaware and Nevada, to offer online betting for real money. In response, the Honorable Robert Smith, chair of the California Tribal Business Alliance and chairman of the Pala Band of Mission Indians, expressed disappointment. "With the approval of the New Jersey online gaming law, the state, which has typically held to the gold standard of gaming regulations, now unfortunately appears to be weakening the eligibility requirements needed to obtain a gaming license," Smith said in a statement. "While the local market in New Jersey may be driving these sorts of decisions, in California we cannot allow for reciprocity with states that have lower standards and softer controls opening the doors to questionable corporations, which now appears to be the case in New Jersey," Smith added. "Gaming at all levels should be held to the same, very high standards set for tribal gaming agencies in California. It is in these regulations that are in place to address the nature and the business of the gaming industry, that we maintain the trust in the game and the confidence of consumers and regional governments to promote a safe, fair and mutually beneficial gaming industry."
